RENTAL AGREEMENT

Agreement made by and between Coatings Connection, a California Corporation, located in Commerce or Los Angeles County, California hereinafter called the Lessor, Coatings Connection, and leased to the below, hereinafter called the Lessee, or Customer.

WITNESSED

That the Lessor and the Lessee for consideration hereinafter named, agrees as follows: Under the general conditions of the Rental Agreement, printed on this page and reverse side of this form, the Lessor rents to the Lessee the items detailed above in good operating condition to be used on or near Los Angeles County, in the state of California.

DAMAGE PROTECTION AND ULTIMATE RESPONSIBILITY

A non-refundable damage protection fee of 15% will be automatically added to each rental unless a valid insurance certificate is on file at Coatings Connection naming Coatings Connection as an additionally insured on Lessees' general liability policy. Renters must check with their insurance carriers to ensure they have proper coverage (whether it be scheduling of equipment or adding an additional rental equipment endorsement) and such coverage must be clearly depicted on the certificate of additional insured provided. Coatings Connection recognizes that this may cause renters to incur additional expense, inclusive of perhaps a fee for the certificate of additional insured; however, there is no exception to this requirement of our needing proper coverage in order for our damage protection fee to be waived. Additionally, the ultimate responsibility for all equipment lies on the Lessee. Should any equipment be lost, stolen, damaged, mis-used, abused, neglected or subject to acts of God, Lessee will be responsible for full “new” replacement value of such equipment. The damage protection fee ONLY covers repairs that arise from normal wear and tear and maintenance. All replacement and/or repair costs outside of this coverage will be the sole responsibility of the Lessee.

BODILY INJURY AND OTHER PROPERTY DAMAGE

Lessor is not held liable for any bodily injuries and/or damages caused to persons, animals and/or surrounding property due to the loading, unloading, handling and/or operation of any unit. It is the sole responsibility of the Lessee to ensure that these damages do not occur. The Lessee is held solely liable for such damages resulting from equipment malfunction, acts of God, or any other unforeseen events. Lessor is responsible for all liabilities that may occur after the unit(s) has left the premises located at 2201 Yates Ave Commerce, CA 90040 no matter if the unit is being delivered by Coatings Connection or picked up by Lessee. Lessor cannot be held liable for any bodily harm and/or surrounding property damages that occur while unit(s) are in the possession of the Lessee.

CLEANING AND DECONTAMINATION OF EQUIPMENT

Equipment must be returned clean, inclusive of any dustbins being free of dust and debris, or a fee of up to $500 per rental unit may be added. When rental equipment is used on hazardous material as defined by State and/or Federal regulatory agencies, Lessee shall provide written confirmation of their decontamination of equipment and disposal of contaminated consumable and parts in accordance with State and Federal agency guidelines. Rental rates will continue to apply to any equipment returned without the required confirmation until such confirmation is received.

COATINGS CONNECTION RENTAL SUPPORT

If you experience problems or issues with your rental equipment it is imperative that stop use of equipment immediately and communicate with our staff, so we can promptly and properly address the issue. Please phone our technical support line at (833) 873-6871 as soon as possible and one of our representatives will be able to assist you as soon as possible. Anytime your call is not answer, leave a message in the mailbox and a staff member will contact you back as soon as possible. Do not attempt to repair any issues on your own. Failure to make contact with our on call technician at the time a problem occurs will result in 100% of rental charges being applied for the duration of the rental period and/or full liability of the repair costs associated.

*Note: Copy of Drivers Valid License is required at pick up.

THE LESSOR AND LESSEE FOR THEMSELVES, THEIR SUCCESSORS, EXECUTORS, ADMINISTRATORS AND ASSIGNS, HEREBY AGREE TO THE FULL PERFORMANCE OF THE COVENANTS HEREIN CONTAINED, INCLUDING THE TERMS AND GENERAL CONDITIONS OF RENTAL AS DEPICTED ON THE RENTAL AGREEMENT INVOICE, WITNESS WHEREOF THEY HAVE EXECUTED THIS AGREEMENT THE DAY AND YEAR FIRST WRITTEN ABOVE

INSPECTION

All equipment and tooling passed the attached inspection when the lessee took possession of the unit(s).

*PLEASE NOTE: In the event the rental is not returned by the expected return date, the credit and/or debit card presented will be charged the daily rental rate each day until the rental is returned to Coatings Connection.
